Terms of Service

Last Updated: [December 7 2024]

1. Acceptance of Terms

By accessing or using the Droplet Ecosystem, its associated platforms, tools, tokens, services, websites, interfaces, or documentation (collectively, the "Services"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with these Terms, you are prohibited from using or accessing the Services.

These Terms apply to any and all users of the Services, including, without limitation, individuals, entities, token holders, contributors, developers, researchers, and community members (collectively, "Users"). Your continued use of the Services constitutes acceptance of any modifications to these Terms, which may be updated from time to time without prior notice.

2. Decentralization and Dynamic Nature of the Services

The Droplet Ecosystem and its components, including but not limited to Nimbus, the DAAIO (Decentralized Autonomous Artificial Intelligence Organization), AI-driven governance models, token emission processes (Bucketing), and associated marketplaces, operate within decentralized, rapidly evolving environments. These environments may be subject to substantial changes, including updates, modifications, feature removals, and reorganizations, without prior notification.

By using the Services, you acknowledge and accept that:

  • The ecosystem’s rules, governance parameters, tokenomics, and selection criteria for roles such as Neurons may change at any time due to community voting, AI-driven reconfiguration, or shifts in strategic priorities.

  • The documentation, roadmaps, metrics, and policies provided are for informational purposes only and may not reflect the current state of the ecosystem.

  • No guarantees are made regarding the permanence, continued accessibility, or functionality of any aspect of the Services.

3. Assumption of Risk

3.1 Volatility and Speculation: Cryptocurrencies and related digital assets, including the Droplet ($DRPL) token, are inherently volatile and may experience unpredictable price fluctuations, significant losses, or even complete devaluation. Market conditions are often influenced by factors outside of any individual’s control, and Users engage in token acquisition, trading, holding, or utilization entirely at their own risk.

3.2 Decentralized Governance and Uncertainty: The DAAIO governance model, AI-driven decision-making, and community-based proposals may result in outcomes that are not aligned with individual Users’ expectations or interests. Proposed changes, partnerships, integrations, or strategic initiatives may fail to materialize, be executed differently than anticipated, or be reversed at a later stage.

3.3 No Guaranteed Returns or Financial Advice: The Services, including any tokens, emissions, buybacks, burns, or grants, are not investment products, securities, or financial instruments. Nothing in the Services, documentation, or associated communications should be construed as financial advice, investment advice, or a recommendation to partake in any financial transaction. Users must conduct their own due diligence, consult with qualified professionals, and assess their risk tolerance before acquiring or using digital assets connected to the Droplet Ecosystem.

4. Disclaimers

4.1 "As Is" and "As Available": The Services are provided on an “as is” and “as available” basis without warranties of any kind, whether express or implied. To the fullest extent permitted by law, the owners, creators, developers, contributors, maintainers, and any affiliates (collectively, the “Team”) disclaim all warranties, including without limitation any warranties of merchantability, fitness for a particular purpose, non-infringement, availability, security, or accuracy.

4.2 Technological and Regulatory Uncertainty: The blockchain and AI landscapes are subject to continuous legal, regulatory, and technological changes. The Services may be impacted by shifts in laws, enforcement actions, compliance requirements, technological failures, software vulnerabilities, cyberattacks, or other unforeseen events. The Team disclaims any liability for losses arising from such uncertainties or disruptions.

5. Limitation of Liability

To the fullest extent permissible by applicable law, in no event shall the Team be liable for any direct, indirect, punitive, incidental, special, consequential, or exemplary damages, including without limitation damages for loss of profits, goodwill, data, or other intangible losses, arising out of or relating to the use, inability to use, or performance of the Services, even if advised of the possibility of such damages.

The Team shall not be liable for any decisions made, actions taken, or losses incurred as a result of interactions with the DAAIO, AI-driven governance, token emissions, market conditions, or other decentralized features of the Droplet Ecosystem. Users assume full responsibility for their actions, transactions, and engagements within the ecosystem.

6. No Fiduciary Duties or Professional Advice

The Team does not act as a fiduciary, financial advisor, investment manager, broker, dealer, or any other form of regulated professional. No communication, documentation, or interaction with the Services should be interpreted as the provision of legal, tax, investment, accounting, or financial advice. Users are solely responsible for seeking appropriate professional guidance before participating in the ecosystem.

The Services may integrate or provide links to third-party platforms, websites, tools, or marketplaces. The Team does not endorse, control, or guarantee the availability, legitimacy, accuracy, or security of these external resources. Interactions with third-party services are governed by their respective terms and policies, and Users bear all associated risks.

8. Indemnification

Users agree to indemnify and hold harmless the Team from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to their use of the Services, violation of these Terms, or infringement of any intellectual property or other rights of any third party.

9. Changes to Terms

These Terms may be amended, updated, or otherwise modified at any time without prior notice. Continued use of the Services following any changes constitutes acceptance of the new Terms. Users are encouraged to periodically review these Terms to remain informed of any updates.

10. Governing Law and Jurisdiction

The interpretation, validity, and enforcement of these Terms shall be governed by the laws of the applicable jurisdiction, without regard to conflict of laws principles. Any disputes arising from or relating to these Terms, the Services, or the Droplet Ecosystem shall be subject to the exclusive jurisdiction of the competent courts in such jurisdiction, unless otherwise required by applicable law.

11. Severability

If any provision of these Terms is deemed unlawful, void, or unenforceable, that provision shall be severed from these Terms without affecting the validity and enforceability of the remaining provisions.

12. Entire Agreement

These Terms constitute the entire agreement between Users and the Team with respect to the Services and supersede all prior or contemporaneous understandings and agreements, whether written or oral.

13. Decentralized Governance and Non-Governmental Affiliation

The Droplet Ecosystem operates as a Decentralized Autonomous Organization (DAO) and is not governed, regulated, or affiliated with any single governmental entity, regulatory body, or centralized authority. Governance and decision-making processes within the ecosystem are collectively managed through the Decentralized Autonomous Artificial Intelligence Organization (DAAIO) framework, which leverages the collective intelligence of the Neural Network of Neurons and the broader community. Consequently, all rules, policies, and operational protocols are inherently flexible and subject to modification based on consensus-driven governance, evolving market dynamics, technological advancements, and strategic realignments. Users acknowledge and agree that these modifications may occur without prior notice, reflecting the dynamic and adaptive nature of the decentralized ecosystem. By participating in the Droplet Ecosystem, you accept that governance is decentralized and that policies may evolve to meet the community’s collective needs and objectives.
